Terms of Use
This is a translation for convenience. The Czech-language version is the legally binding one.
1. Who we are
1.1. The website https://orivanta.app (hereinafter the "Website", "ORIVANTA", or "we") is operated by:
- Fluxsoft Cloud s.r.o.
- Company ID (IČO): 29741939
- Registered office: Zenklova 24/54, Libeň (Praha 8), 180 00 Praha
- Registration: entered in the Commercial Register maintained by the Municipal Court in Prague
- Email: [email protected] (enquiries, complaints, personal data protection and reports of illegal content under the DSA)
1.2. We are not a VAT payer. The prices stated on the Website are final.
1.3. These Terms govern the use of the Website and the relationship between ORIVANTA and the User. By registering or paying for an order, the User confirms that they have read these Terms and agree to them without reservation.
2. Definitions
- User — a natural person or legal entity using the Website.
- Consumer — a User who is a natural person and acts outside the scope of their business activity (Section 419 of the Civil Code – OZ).
- Business Customer — a User acting within the scope of their business activity.
- User Materials — all content uploaded or entered by the User: photographs, names, texts, questionnaire answers, audio recordings, etc.
- Result — digital content created to order: a video, song, greeting card, illustrated book, etc.
- Generation — the process of creating a Result using artificial intelligence models provided by third parties.
- AI Providers — external third-party companies whose machine learning models are used for Generation (e.g. OpenAI, ElevenLabs, Google).
3. Our role and the nature of the service (Intermediation)
3.1. ORIVANTA is solely a technical online platform (intermediary). We bring together tools for generating content using artificial intelligence. The User enters parameters, the Website passes this data to the models of the AI Providers and delivers the Result back to the User.
3.2. ORIVANTA does not create the Result as an author or creatively. The Result is generated fully automatically by third parties. We do not manually check each Result before it is delivered.
3.3. Nature of generative AI. The User acknowledges and expressly agrees that:
- (a) the Result is generated anew each time. Two identical requests may produce different results;
- (b) the Result may contain inaccuracies (AI hallucinations), visual artefacts, stylistic deviations or a tone of voice different from what the User subjectively expected;
- (c) the samples on the Website are for illustrative purposes only.
4. Account and age restrictions
4.1. Creating an account and placing orders is permitted to persons over 16 years of age. Persons over 18 may pay for orders independently; minors only with the consent of a legal guardian.
4.2. The User is fully responsible for the security of their account. In the event of a breach of these Terms, we reserve the right to block or cancel the account.
5. Order and payment
5.1. Prices are stated on the Website. The contract is concluded at the moment of successful payment.
5.2. Payments are processed by Stripe Payments Europe, Ltd. ORIVANTA does not store payment card data and has no access to it.
5.3. If a manifestly incorrect price is displayed on the Website as a result of a technical error, we reserve the right to cancel the order with a full refund.
6. Delivery and the right of withdrawal from the contract (Consumers)
6.1. Generation of the Result usually begins immediately after payment.
6.2. Loss of the right of withdrawal (Digital content): The Result constitutes the supply of digital content not supplied on a tangible medium. By accepting these terms and ticking the relevant box before payment, the Consumer expressly agrees that performance (Generation) will begin before the 14-day withdrawal period has expired, and acknowledges that by doing so they lose the right to withdraw from the contract without giving a reason (Section 1837(l) OZ).
6.3. The service is also created according to the User's individual requirements (Section 1837(d) OZ).
Retention of the Result and the obligation to download it
6.4. The completed Result is stored in the User's account for 90 days from the day it was completed and made available. The date on which storage ends is shown for each order in the account.
6.5. No later than 7 days before this period expires, we will send the User a notification to the email address stated in the account. Failure to deliver the notification for reasons on the User's side (e.g. a spam filter, an invalid or unavailable address) does not extend the period. If the notification cannot be sent for reasons on our side, deletion is postponed until it is sent, but by no more than 30 days; after the notification is sent, the User always has at least 7 days to download.
6.6. After the period expires, the Result files, sharing links and the content of the input (questionnaire) are automatically and irreversibly deleted; recovery is not possible. We keep the payment record for the period required by accounting and tax regulations.
6.7. The User is obliged to download the Result within the period and keep their own copy. The User is solely responsible for the loss of a Result that the User did not download within the period. Deletion after the period expires is not a defect in performance and gives rise to no claim for a refund of the price or for new Generation.
6.8. We delete photographs and other materials uploaded by the User immediately after the order is completed (or after it is found that it cannot be completed), and in any case within 7 days of their upload. Orders in progress (drafts) that have not been changed for more than 90 days are deleted.
7. Complaints and strict refund rules (Refund Policy)
7.1. Basic rule: The price of the service covers primarily non-refundable computing costs (API calls) charged by AI Providers, which are consumed at the moment of Generation. For this reason, subjective dissatisfaction with the artistic, aesthetic or stylistic rendering of the Result (I do not like the music, the look of the character, the tone of the voice) is NOT a ground for a refund. For such cases, free corrective Generations are available (according to the current offer on the Website).
7.2. When we refund: Money may be refunded only in the case of a technical defect on our side, where:
- (a) the Result was not created or delivered at all due to a demonstrable failure of our platform or of an AI Provider;
- (b) the Result is technically damaged (e.g. the file cannot be opened, the video has no audio track);
- (c) the Result grossly does not correspond to the purchased format (e.g. the User paid for a video and received only text).
7.3. Unjustified complaint (No defect exists): It is expressly not considered a defect if:
- (a) the Result contains errors caused by the User Materials (typos, an inappropriate or poor-quality source photograph, a language incorrectly chosen by the User);
- (b) the Result was blocked by an automated system due to a breach of the content rules (see clause 8). In such a case the funds spent are forfeited as a contractual penalty for breach of the Terms.
7.4. Investigation: We carefully examine every complaint and refund request on the basis of our server logs and API records, which clearly determine on whose side the error arose.
8. User responsibility and prohibited content (Zero tolerance)
8.1. Sole responsibility of the User: The User bears full, sole and unlimited responsibility for all User Materials that the User uploads, enters or sends through the Website. ORIVANTA acts solely as an information society service provider (hosting) and is not responsible for content stored or transmitted by the User within the meaning of the law and the DSA Regulation.
8.2. By uploading Materials, the User declares and warrants that:
- (a) they are the author of the Materials or hold all necessary licences and rights (including copyright in music and texts);
- (b) they have the express consent of every person depicted or named to the use of that person's photograph, name and personal data to create the Result and its possible dissemination (Section 84 et seq. OZ – protection of likeness and privacy). For children under 16, they have the consent of the legal guardian.
8.3. It is STRICTLY PROHIBITED to generate, upload or disseminate:
- (a) material of a sexual nature (in particular involving minors) or any explicit content involving real persons;
- (b) photographs of persons without their consent, for the purpose of bullying, defamation or harassment;
- (c) deceptive content (so-called deepfakes with malicious intent), fraud, political propaganda;
- (d) hate speech, expressions of extremism;
- (e) copyright-protected works (well-known songs, logos) without authorisation.
8.4. Indemnification: Should third parties (or public authorities) raise any claims against ORIVANTA because of content uploaded by the User, the User undertakes to fully indemnify our company for all resulting damages, fines and legal representation costs.
9. Rights to the Result and AI labelling
9.1. Under Czech copyright law, only a natural person can create a work. An automatically generated Result may therefore not be subject to copyright protection.
9.2. The User obtains a non-exclusive right to use the Result for personal and non-commercial purposes. Commercial use is possible only for Business Customers on the basis of a special agreement.
9.3. In accordance with Regulation (EU) 2024/1689 (AI Act), it must be evident that the content was generated by artificial intelligence. The User must not remove watermarks or other indications of origin if the Result is disseminated publicly.
10. Moderation and reporting of content (DSA)
10.1. We may filter content both automatically and manually. In the event of a breach of clause 8, we are entitled to delete the account immediately without compensation.
10.2. The point of contact for reporting illegal content under the Digital Services Act (DSA) is the email: [email protected].
11. Limitation of ORIVANTA's liability
11.1. The service is provided "as is". We disclaim liability for any damages arising from inaccuracies of AI models, connection outages, or the conduct of third parties.
11.2. We bear no responsibility for how the User deals with the created Result and to whom the User forwards it.
11.3. These limitations do not apply to damage caused intentionally or by gross negligence, as required by Section 2898 OZ.
12. Final provisions
12.1. Dispute resolution: The Consumer may contact the Česká obchodní inspekce (Czech Trade Inspection Authority, ČOI), address: Štěpánská 567/15, 120 00 Praha 2, website: adr.coi.cz.
12.2. The relationship is governed by the law of the Czech Republic.
12.3. These Terms are effective from 18.10.2026.
